Summary of Individual Agreements Approved By the Board of Education on June 1

On February 25, the Manhasset Board of Education announced that it had reached a global settlement of all issues with the Manhasset Education Support Personnel Association (MESPA) in relation to MESPA’s lawsuit on the district’s outsourcing of transportation in July 2005. At its June 1 meeting, the board of education approved agreements with the individual members of the district’s former transportation department:

• 37 settlement and general release agreements to buy out comparable work positions, 35 at $110,000 and 2 at $55,000. The 37 positions represent ALL comparable work positions that were the subject of the lawsuit. These agreements include a complete release for the district of all liability with respect to comparable work positions and the issue is closed.

• 29 settlement and general release agreements for damages in lieu of back pay or back pay. These agreements include a complete release for the district of all liability with respect to damages in lieu of back pay/back pay:

• The average settlement for damages in lieu of back pay/back pay is $65,802.

• The average interest on such damages in lieu of back pay/back pay is $19,026.

• Total average settlement for damages in lieu of back pay/back pay including interest is $84,828.

• The lowest settlement for damages in lieu of back pay/back pay including interest is $1,681.

• The highest settlement for damages in lieu of back pay/back pay including interest is $227,707.

It should be noted that:

• 3 persons were not entitled to damages in lieu of back pay or back pay.

• 3 persons had previously settled on damages in lieu of back pay.

• 3 persons have not yet settled on back pay only (two former employees are currently negotiating and one employee is deceased and the agreement is the subject of estate proceedings). Under the district’s agreement with MESPA, back pay and interest was cut off at January 31, 2010.

The above amounts are for this group of payments only. A complete analysis of the settlement payments, including taxes and pension costs, will be circulated once the three outstanding agreements are completed and pension payments are finalized.
